Introduction

Welcome to Dugasta Properties Development, a property development company registered and operating within the jurisdiction of Dubai, United Arab Emirates (“us”, “we”, “our”). Our website dugasta.com (“Site”) is a digital platform showcasing our property portfolio and offering reservation services compliant with the standards and regulations set forth by the Real Estate Regulatory Agency (RERA) of Dubai.

By accessing or using our Site, you confirm that you accept these Terms and Conditions and that you agree to comply with them. If you do not agree to these Terms, you must not use our Site.

Use of Site

This Site is intended for use in accordance with the laws of Dubai and the federal laws of the United Arab Emirates. It is subject to the regulations and oversight of RERA and is intended to provide clear, fair, and lawful property reservation services.

Property Reservation

  • Non-Refundable Reservation Fee

In accordance with RERA guidelines, we offer the ability to reserve a property by paying a specified reservation fee through our Site. This fee is a commitment to proceed with the purchase of a property and is therefore non-refundable, except as permitted by Dubai law.

  • Reservation Period

A property will be reserved for the client upon the payment of the reservation fee for a period of fourteen (14) days (“Reservation Period”). This is to provide sufficient time to commence the formal purchase process in line with RERA’s regulations.

  • Forfeiture and Completion

If the full booking amount as per the sale agreement is not received within the Reservation Period, the reservation will be forfeited. The property will then be released for reservation to other clients. The forfeited reservation fee shall serve as liquidated damages for the reservation cancellation, as per the regulations of RERA and applicable Dubai law.

Intellectual Property Rights

The content of this Site, including but not limited to text, graphics, logos, and images, is the property of Dugasta Properties and is protected by copyright laws. Any unauthorized use of this material is prohibited and may result in civil and criminal penalties.

Privacy Policy

Our Privacy Policy outlines our practices concerning the collection, use, and disclosure of your personal information and is compliant with the Dubai Data Protection Law.

Modification of Terms

Dugasta Properties Development reserves the right to modify these Terms and Conditions at any time. By continuing to use the Site after such modifications, you agree to be bound by such modifications.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Dubai and the applicable federal laws of the United Arab Emirates. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.
